1. Acceptance of Terms
Welcome to Mistryo ("we," "our," or "us"). By accessing or using the Mistryo website (www.mistryo.com), mobile applications, or any associated services, you agree to comply with and be bound by these Terms of Service. These terms govern your access to the platform, whether you are a "Customer" seeking services or a "Partner/Technician" providing services.
If you do not agree to these Terms, you may not access or use the platform.
Core Philosophy: Mistryo is dedicated to organizing the unorganized blue-collar sector. We prioritize dignity of labor for our technicians and transparent, reliable service for our customers.
2. The Role of Mistryo
Mistryo operates strictly as a technology marketplace that connects independent home service professionals (Technicians) with end-users (Customers). We provide the digital infrastructure for lead generation, verified reviews, and secure matching.
- Not an Employer: Mistryo does not employ the technicians registered on the platform. They operate as independent contractors.
- Service Quality: While we enforce strict background checks and skill verifications to award the "Verified Pro" badge, the actual contract for service is directly between the Customer and the Technician.
3. Payments & Zero Commission Model
Unlike traditional aggregators, Mistryo operates on a revolutionary financial model designed to empower technicians.
- For Customers: The prices listed on our platform are estimates based on standard market rates. You must agree on the final price with the technician after physical inspection and before the work begins. You will pay the technician directly via Cash or UPI. Mistryo does not hold or intercept your payments.
- For Partners (Technicians): Mistryo takes 0% commission from your labor charges. Partners are only required to pay a flat platform lead fee (e.g., ₹150) per successfully completed job, or subscribe to an optional "Verified Pro" membership plan to boost profile visibility.
4. Customer Responsibilities
To ensure a safe and smooth service experience, customers utilizing the Mistryo platform agree to the following:
- Safe Environment: You agree to provide a safe, respectful, and hazard-free environment for the technician to perform their duties.
- Verification: While Mistryo verifies technicians digitally, you are advised to ask for their physical Mistryo ID or government ID before allowing entry into your home.
- Payment: You agree to pay the technician the agreed-upon amount promptly upon the satisfactory completion of the service.
- Accurate Information: You must provide accurate address and contact details to prevent dispatch failures.
5. Partner (Technician) Obligations
Technicians representing Mistryo in the field are held to the highest standards of professionalism:
- Transparency: You must never overcharge customers. You must provide clear, upfront pricing for spare parts before installation.
- Genuine Parts: You must use original, brand-compatible spare parts for all repairs and installations.
- Zero Tolerance: Any confirmed reports of physical/verbal harassment, theft, working under the influence, or extreme unprofessionalism will result in an immediate, permanent ban without a refund of subscription fees.
6. 30-Day Service Warranty Terms
Mistryo backs the work of its "Verified Pro" partners with a 30-Day Service Warranty. The conditions for this warranty are as follows:
- The warranty covers labor only for the exact same issue that was repaired originally.
- If the appliance breaks down again due to the same fault within 30 days of the invoice date, the technician will revisit and fix it without charging a visiting or labor fee.
- Exclusions: The warranty is void if the appliance is tampered with by another mechanic, if the issue is caused by sudden physical damage/power surges, or if the customer refused to replace a part initially recommended by the technician.
- Warranty on spare parts is governed by the respective manufacturer's policies, not Mistryo.
7. Intellectual Property Rights
All content, logos, graphics, text, and software code on www.mistryo.com are the exclusive intellectual property of Mistryo and its founder. You may not copy, reproduce, scrape, or distribute any part of our platform without prior written consent.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Mistryo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the platform.
- Any conduct or content of any third party on the platform, including but not limited to, the actions of independent technicians or customers.
- Any damage to property or appliances arising during the course of service delivery.
Our aggregate liability for all claims relating to the platform shall not exceed the amount you paid to Mistryo (if any) in the past six months.
9. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms of Service or the Mistryo platform shall be subject to the exclusive jurisdiction of the courts located in Jehanabad, Bihar, India.
